These Terms constitute a legally binding agreement between you ("User," "You") and **Atuega** ("The Platform," "We," "Us"). **IMPORTANT NOTICE: BETA PARTICIPATION & EXPERIMENTAL SOFTWARE** * **By using this Service, you acknowledge that Atuega Omnitutor is currently in a "Public Beta / Trial" phase. The software is experimental, likely to contain errors, and utilizes substantial device processing power. It is NOT currently accredited by any government educational body.** ### 1. Eligibility & Minors **1.1. Minimum Age:** You must be at least 13 years old to register for an account or use the Platform independently. **1.2. Minors (Ages 13–18):** If you are between the ages of 13 and the age of majority in your jurisdiction (typically 18), you represent that you have obtained the permission of your parent or legal guardian to use the Service. Your parent or guardian agrees to be bound by these Terms and accepts full responsibility for your actions on the platform. **1.3. Child Users (Under 13):** Users under the age of 13 are strictly prohibited from using the Service unless supervised by a parent, legal guardian, or authorized adult guide. * **Mandatory Supervision:** Access for users under 13 must be facilitated through an account owned by a parent or guardian. * **On-Device Verification:** We reserve the right to employ on-device AI algorithms to continuously estimate the age of the active user. If a child is detected without an adult guide present, the Service may automatically restrict access. **1.4. Verification:** We reserve the right to audit or request proof of age and parental consent at any time to ensure compliance. ### 2. Nature of Services (Beta, AI & Device Usage) **2.1. Experimental Service:** You acknowledge that the Service is under active development. We do not guarantee uptime, data integrity, or feature stability. We are not liable for any data loss or disruptions caused by testing conditions. **2.2. No Government Accreditation:** This Service is a private educational tool. **It is NOT recognized, accredited, or approved by the Ministry of Education, UGC, AICTE, or any other government regulatory body.** It is intended strictly as a supplementary study aid and not as a replacement for certified schooling. **2.3. AI Accuracy ("Hallucinations"):** Our Service utilizes Artificial Intelligence. You acknowledge that AI may produce incorrect, biased, or outdated information. You should always verify facts with official textbooks. **2.4. Device Resource Usage:** You acknowledge that the "On-Device Tutor Engine" utilizes significant processing power (CPU/GPU/NPU) and battery life to analyze audio and video locally. Atuega Omnitutor is not liable for device overheating, battery drain, hardware degradation, or data overage charges incurred while using the Service. You are responsible for ensuring your device meets the necessary hardware requirements. **2.5. No Academic Liability:** Atuega Omnitutor is not responsible for any academic consequences (e.g., exam failures, low grades) resulting from the use of our services. ### 3. Privacy-First Architecture (On-Device Processing) **3.1. Local Processing Guarantee:** To protect your privacy, our "Tutor Engine" utilizes * **Edge Computing** (processing data locally on your device). * **Video & Audio:** Your camera and microphone feeds are processed **strictly on your device** to analyze facial expressions and convert speech to text. * **No Cloud Transmission:** We **DO NOT** stream, record, upload, or store your raw video or audio data on our servers. **3.2. Data Transmission:** You agree that only the *anonymized text transcript* of your speech and *numerical engagement metadata* (e.g., "User confusion score: High") are sent to our servers to generate the AI tutor’s response. ### 4. User Conduct & Academic Integrity **4.1. Permitted Use:** You agree to use the platform solely for personal educational purposes. **4.2. Prohibited Use:** You agree NOT to: * Use generated content for plagiarism or academic dishonesty. * Share account credentials. * Attempt to reverse-engineer the on-device algorithms or intercept API calls. * Use the platform to generate harmful, abusive, or illegal content. **4.3. Violation:** We reserve the right to immediately ban any user violating these Terms without refund. ### 5. Intellectual Property & Feedback **5.1. Ownership:** All software, design, algorithms, and code are the exclusive intellectual property of Atuega Platform. **5.2. Content License:** We grant you a limited, non-exclusive license to use the study materials generated for your personal use. You may not resell or commercialize this content. **5.3. Feedback Assignment:** If you provide us with any feedback, suggestions, or bug reports regarding the Beta Service ("Feedback"), you hereby assign to us all rights in such Feedback and agree that we shall have the right to use such Feedback for any purpose, including commercial product development, without any compensation to you. ### 6. Payments & Refunds **6.1. Subscription Fees:** Services are billed in advance on a Monthly basis. **6.2. Refund Policy:** Due to the digital nature of the content and the costs of AI processing, all payments are **non-refundable**. **6.3. Pricing:** We reserve the right to change pricing with 30 days' notice. ### 7. Limitation of Liability & Intermediary Status **7.1. Intermediary Status:** Atuega Omnitutor acts as an "Intermediary" as defined under Section 79 of the Information Technology Act, 2000. We engage third-party Large Language Models (LLMs) and AI engines to generate and process responses. We do not consciously review or curate every AI response. We are not liable for any third-party content generated by the AI. **7.2. Liability Cap:** To the maximum extent permitted by Indian Law, Atuega Omnitutor shall not be liable for any indirect, incidental, or consequential damages. Our total liability to you shall be limited to the amount you paid us in the 12 months preceding the claim. ### 8. Force Majeure We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic, or communications failure (e.g., internet service provider failure, third-party AI API outages, or cloud server downtime). ### 9. Termination & Governing Law **9.1. Termination:** We reserve the right to suspend your account without notice for violations of these Terms. **9.2. Governing Law:** These Terms shall be governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts located in **Bangalore, Karnataka**. --- ## PART 2: PRIVACY POLICY (BETA EDITION) **Last Updated:** 15th February 2026 Atuega Omnitutor respects your privacy. Because we use sensory data (camera/mic) for tutoring, we have built our architecture to minimize data collection. This policy explains how we handle your information in compliance with the **Digital Personal Data Protection (DPDP) Act, 2023** and applicable Indian laws. ### 1. The Distinction: Local vs. Cloud Data We classify data into two categories: **Processed Locally** (stays on your phone) and **Collected** (sent to us). **A. Data Processed Locally (NEVER SENT TO SERVER)** * **Raw Video Feed:** Used solely to detect facial expressions and estimate age in real-time. This data is processed in RAM and deleted immediately. * **Raw Audio Feed:** Used solely for Speech-to-Text conversion. * **Biometric Clarification:** For the avoidance of doubt, **we do not collect "Biometric Identification Data"** (i.e., facial recognition to identify *who* you are). We utilize **"Behavioral Analysis"** (identifying *what* you are doing, e.g., gazing away, smiling, frowning). **B. Information We Collect (SENT TO SERVER)** * **Personal Information:** Name, Email, Phone Number, Date of Birth. * **Usage Data:** Text transcripts of your questions, AI-generated answers, and time spent. * **Engagement Metadata:** Anonymous scores derived from local processing (e.g., "Attention Level: 80%"). * **Device Info:** IP address, device model, and OS version. ### 2. How We Use Your Data We use the data collected to: * Provide the AI tutoring service and generate responses. * Personalize the difficulty level based on your engagement metadata. * Process payments via third-party gateways. * Train our AI models to improve answer quality (using anonymized text only). ### 3. Sharing of Information We do not sell your personal data.
